I highly disagree with the proposed restrictions regarding "complex" products, which isn't well-defined in the notice write-up. Not only would creating additional barriers and limiting opportunity to retail would have broader implications and negative outcomes for capital markets overall, but it removes the necessary risk management tools in an increasingly complex and evolving financial world driven by capital investment and accumulation. This lack of equality and freedom perpetuates the double standards between individuals and institutions, and it will already exacerbate the enormous wealth inequality limiting these financial tools to only hedge funds and high net-worth individuals. These regulations, albeit written for good intentions, can very well have the opposite effects like with most cases. Temporary bear market trends and cherry-picked consumer cases are not a part of a total inclusive and rational framework. I implore to decision-makers of FINRA to reconsider their position and truly understand the implications of the regulations they are creating.
