Ernesto Montanez Comment On Regulatory Notice 22-08

I do not agree with the regulations that are being propose for Leverage or inverse ETFs. They are an investment tool that have produce great results for me and my family. This regulations could hurt my ability to make money with these tools. I, not regulators, should be able to choose the public
investments that are right for me and my family. Public investments should be available to all of the public, not just the privileged. Sometimes regulators think they are protecting the public by limiting their ability to use certain tools but what actually happens to middle America is that we fall behind because we do not have access to the same tools as the wealthiest people in the US. I shouldn't have to go through any special process like passing a test before I can invest in public securities, like leveraged and inverse funds. I am capable of understanding leveraged and inverse funds and their risks that come with them. Imposing these restrictions will only hinder my ability to make money in the financial markets. I use options on a regular bases to trade the financial markets. The price points and risk/rewards of options in leverage ETFs are not only better but far more affordable than any normal index like the S&P or the Nasdaq. These index or the ETFs are so expensive that is impossible for the normal American to use them effectively. Leverage ETF's already have safe guards in place to prevent risking more money than what you have. For example I can only use 10% margin on leverage ETF, but I can use 80% to 90% on the normal ETF's or stocks. Using margin this way could not only let me lose all my money, but it could leave me in a large debt in the worst case scenarios. If you take leverage ETF's from the general public, people will resort to using large amounts of margin to get the same financial results. I have been able to grow my net worth by 70% a year from leverage ETF's, without them I will not have the same abilities to create more wealth for me and my family. I implore FINRA to please not pass these regulations that will only hurt the average American.
