Eric Schwartz Comment On Regulatory Notice 22-08

Dear regulators,

I should be able to choose publicly available investments that are right for me and my family. This filling is an over reach. Ordinary Investors like myself and others are much more sophisticated, informed, educated, and savvy than previous generations. With the the prevalence of Fintech platforms and the Internet financial education has never been easier to obtain, and reliance on a financial advisor had never been lower.

I don't need to take a test before I invest in leveraged index funds. I understand the risks and don't need additional measures imposed.

Leveraged funds are used in a very small quantity in my portfolio, with the intent being to produce enhanced returns without resorting to even riskier investments like options trading.

This is a radical and unprecedented measure that removes power from ordinary Investors in favor of institutions, and will push investors to even riskier options since there will always be an appetite for seeking higher return investments.

My personal experience is that I'm able to do my own research and due diligence on an investment, including leveraged etfs, model their performance as part of a diversified portfolio including risk/return potential and invest in them with an educated point of view. This has served me well. And FINRA does not need to step in and protect me.
