I have used this product both as an advisor and now as a retired advisor, but now as a regular investor.
The availability of easy products like the inverse ETF is simple to use and should not be as restrictive as it currently is.
I find it odd, that now that the bull market is struggling, here comes the big brother regulators taking away the protection investors need.
You should NOT make this more difficult for investors, you should make it easier. In fact, the entire system is bias to the long side and this feels like market manipulation to me.
You should be making all forms and all 401ks offer a way for investors to play the downside besides cash. The system is rigged enough already without the industry heavyweights squashing individual investors.
Stay out of this unless you plan to make these products even more accessible.
