Preliminary Version of OATS Compliance Report Card - Available for June 2009
Beginning with the June 2009 reporting period, FINRA is issuing a preliminary version of the OATS Compliance Report Card in an effort to provide firms with more timely information regarding their overall OATS compliance performance. The report card, accessible only through FINRA's Report Center, will be made available approximately eight business days after the end of a report period and will include text at the top of the report identifying the data as preliminary.
The preliminary report card will contain all daily OATS statistics for the prior month, along with industry and peer group comparisons and detail data. The data contained in this report card will not be validated or checked for integrity prior to publication. Report Center users will receive an email when the report card is available.
FINRA will continue to publish a final, validated version of your firm's OATS Compliance Report Card approximately 28 days after the end of each report period. This version will be available through both the FINRA Report Center and the NASDAQ Trader Web site. You will receive an email notification once the final report card has been published, along with a summary of any changes that were made during the validation process.
Please note that beginning in September 2009, FINRA's Market Regulation Department intends to identify firms whose non-compliance rates fall outside of their peer group norms based on calculations from the preliminary version of the August OATS Report Card, which will not have been validated or checked by FINRA. If your firm falls into this category for a particular report period, FINRA will notify your firm's OATS Principal via email. This notification is intended to serve only as a compliance tool for your firm and does not require any response. The notification does not serve as a disciplinary action by FINRA.
